NPBN wants to keep your information private and below is our privacy policy for doing that. Please note that it is part of a legally binding agreement with you because it is incorporated into the Terms of Use (which can be found at www.npbn.com/terms.aspx). The Terms of Use explain such legal matters as limitations of liability and the actual use of NPBN services. If you do not agree with these terms then you are not permitted to use any services provided by NPBN. You can also contact us with requested changes at privacy@npbn.com. 1. Our General Principle: Private Information Is Private

Our basic principle is that private information is private. This means that:

  1. We will not sell information about you as an individual to third parties.

  2. We will not provide information collected by or on behalf of NPBN to third parties for them to contact you, unless you have expressly given us permission to do so.

  3. We will contact you when it is necessary or appropriate for the service (for example, service outages, change in email addresses, etc.) or when you have given your consent to us to contact you.

We will aggregate information about many users but not with information identifying you (e.g., your name or your contact information) to enable us to improve the service or to enable advertisers to deliver advertising to you. But, once again: We will not give information to third parties to contact you unless you explicitly permit us to do so.

Please note that NPBN is not appropriate for users under 13.


2. What We Collect

What we collect depends upon what services you wish to use from NPBN.

Just Visiting. When you visit NPBN, your computer will usually interact with our services, providing us with your browser type and IP address, which we use to maintain the site and to report usage information. We use "cookies" placed on your computer that provide certain information. You can change how your computer interacts with these cookies, but sometimes those adjustments may affect the delivery of NPBN Services. This information is not "personally identifiable information."

Registering. If you want to use some of the services you will need to register. There you provide us with basic information about yourself. That information might include contact information-usually just your email address. That information is "personally identifiable information." It is also termed "PII." The contact information will be used only to inform you of service changes and the like, unless (and only if) you give us explicit permission to use it to contact you. For example, you might want to order a copy of a film you have seen on NPBN-in which case, we will obviously need to know how to contact you. Please note that you might change that registration information from time to time. We will keep the old information archived for a reasonable period.

Preferences. You may want to indicate to us your preferences for certain things. For example, you might want to tell us the kinds of videos you like to view so that we can display them to you according to your preferences. The more such information the better the services of NPBN for you. That information would be stored so that you do not have to enter it every time you visit.

Uploading Videos. If you want to upload videos, then there is additional information you will need to give us. That information would fall within the category of personally identifiable information, or PII. We will need that information for several reasons. First, we may need to work with you on editing the video or on other methods of distribution. If we cannot reach you then it is unlikely that we will post what you have submitted.

Other Posted Content. Users may post comments, blog entries and other such content on their own. In doing so, users put their names (or their screennames). Sometimes users even put their email addresses or other contact information in such comments. What you post that is personally identifiable information is up to you. It is not confidential. And we cannot be liable for the consequences of you posting such information (that limitation of liability is covered in the Terms of Use. Click www.npbn.com/terms.aspx).

Information Collected through Advertisements & Links. NPBN displays advertisements from other companies and includes links from other companies. These ads often incorporate technology to test the effectiveness of the ad, much as cookies operate, or they are ads on which you click. If you do so, then what information is collected there will be governed by the privacy policies of those advertisers. We work with the networks that are considered to be the best in the advertising business, so we have confidence in them and in their ability to make sure that advertisers using them have excellent privacy policies. NPBN will not be liable for anything that happens when you visit those sites. The links will take you to other sites, where the relationship with you will be governed by the owners of that site.

System Performance & Feedback. You may end up sending us some feedback and including your contact information. This might be, for example, because of a technical problem on one of our sites. In such cases, we will only keep your contact information for as long as it is necessary to fix the problem and let you know and then we will delete that information in a reasonable period after doing so.

Purchasing Something. Obviously, when you purchase something via NPBN, you will be giving us personally identifiable information so that we can deliver it to you and get paid for providing it to you. We will use that information only to complete the transaction.

When You Give Us Permission. There may be times when you give us permission to use your personally identifiable information. We will not seek that permission in the small type of a dense legal document. We will ask you directly on the website (or by a mobile device) and we will only use the information in the way you have permitted us to use it. You will also be able to withdraw that permission at any time.

Other Information. We may decide to collect other information but, first, we will post any changes to this policy explaining what the information is and what to do with it. We may also receive information about our users from third parties but, again, this is not personally identifiable information. If it is, then it is for a specific reason-i.e., a violation of a law.

3. How We Use This Information

We use the information we have collected in two ways: internally and in cooperation with third parties.

Internal Use.

Aggregated Information. Internally, we will look at the information to determine the performance of our services, both in terms of its operating performance and its quality. We do so by aggregating the information but it is not personally identifiable. This means that we will create a large database of all users but without their personally identifiable information (i.e., contact information) to use to see how we are doing.

In other words, we will not know if you liked a given movie simply because you have viewed it or you have registered, but we will try to find out information like how many users liked it when it was displayed on the home page versus an interior page, in what zip codes were they located and so forth. This does not change when you register (that is, you give us contact information).

System Performance, Feedback and Special Services. We may need or want to let you know that some part of the services will be changed or some other aspect of delivering the service to you. We may ask you to participate in a survey, in exchange for some benefit you can then receive. The contact process may be done by a third party but they will not have the right to use that information for any purpose other than to fulfill their contract with us to send you that information.

Using Information with Third Parties.

Improving the Services. NPBN works with third parties to provide content, technology, advertisements and features and functionality. In those cases, we will provide aggregate information discussed above (that is, without personally identifiable information). This will help to improve what NPBN provides to you because we can change things that work or do not work.

Special Offers. In some cases, we may work with third parties to provide special offers-such as an offer to buy a download of a great movie or a CD of great music. In those cases, you will be providing us with personally identifiable information (there is no way to ship you that CD without it). That information will be used by us only to complete the transaction. Be aware, though, that you may use a credit card or other form of payment that has other terms of privacy and information use by the issuer of that card. That does not involve us.

Legal Demands. We may be required to disclose information to comply with a legal request, such as a court order or for some other form of compliance with applicable laws or because we reasonably believe that there is a grave risk that must be avoided by such disclosure. We will not do so unless we believe that the request or the situation meets the necessary legal standards for doing so and when we do so, we will release what we believe to be that which is the minimum needed to comply.

Sale of NPBN. If NPBN were to be sold (or otherwise merged into another company, etc.), that transaction would obviously mean that the information we collected would then be held by the acquiring company. That information would remain subject to the terms made in the then-existing privacy policy and TOU until the new owner decided to make changes to those agreements.

4. Security

We use physical and technical means to protect the information that we have collected. No system is perfect, but we believe it is quite good. We believe that it is good enough that you should not worry. Don't worry, we will upgrade it on a frequent basis.

5. Legally Binding Agreement & Changes to This Policy

Legally Binding Agreement

As we noted at the start of this privacy policy, this privacy policy is incorporated into the Terms of Use, which is a legally binding agreement between NPBN and you. That means that the provisions of the Terms of Use will apply to any disputes on this privacy policy.

Changes to This Policy

We can change this policy by posting a new policy, which will immediately take effect. Please note: Your use of the NPBN services prior to such posting (and your acceptance of the terms by your subsequent use) will continue to be governed by the previous terms of this privacy policy. New terms affect only new activity by you. The old terms will be located at www.npbn.com/privacy/archives.

You should still review the posted privacy policy from time to time so that you understand its teams.
